Participation Conditions for Competitions and Prize Draws

d&b audiotechnik GmbH & Co. KG (hereinafter called d&b) occasionally holds competitions and prize draws (hereinafter called "competitions") in conjunction with surveys. Participation in these competitions shall be subject to the following Participation Conditions.

Organizer

The competitions shall be staged by d&b audiotechnik GmbH & Co. KG, Eugen-Adolff-Strasse 134, 71522 Backnang.

Participation requirements

Participation in the competition shall be free of charge and shall not involve the purchase of any products or services. However, previous participation in a survey shall be a prerequisite for participation in a competition. The competition shall only be open to participants who answered all the questions in the survey or the competition and provided all the required information. Every entry received shall be entered in a prize draw in which the winners shall be chosen based on the random principle. Each participant may only enter the competition once and may only win one prize. The prize shall not be paid out in cash or be transferred to other persons. d&b shall inform the winners by means of an e-mail. If a winner fails within 21 days after notification to send d&b an e-mail confirming his/her prize win and containing the address to which the prize is to be sent, the winner's claim to the prize shall be forfeited and a substitute winner shall be chosen using the same method. The participant shall be responsible for the accuracy of his/her specified address. The prize may only be sent if it is not subject to export bans. The prizes on offer in the respective competition shall be sent to the respective winners free of charge. All additional participation requirements, e.g. the competition period and the date on which the winner is drawn, are shown on the competition page.

Participation eligibility

The competition shall be open to everyone aged 18 and over. In order to take part in the competition, the participant shall provide truthful personal details. Employees of d&b audiotechnik GmbH & Co. KG, its subsidiaries or other companies in the d&b Group shall not be eligible to take part in the competition. d&b shall be entitled to exclude individual persons from taking part in the competition if there are justified reasons for doing so, e.g. infringement of the Participation Conditions, participating twice, manipulations, etc.

Changes to the Participation Conditions and end of the competition

d&b shall reserve the right to change the Participation Conditions at any time. d&b shall also reserve the right to end or suspend the competition any time without prior announcement for good cause. This shall apply, in particular, to reasons which would disrupt or hinder the scheduled competition process.

Liability restrictions

d&b shall only be liable for damage which it or its agents caused through the infringement of essential obligations (cardinal obligations) during the competition. In particular, d&b shall not be liable for damage caused by faults in technical equipment, for delays/interruptions in transfers or for damage relating to participation in the competition or through acceptance and use of the prize. Liability shall be restricted to foreseeable and typically occurring damage.

This liability exclusion shall not apply if d&b causes the damage intentionally or through gross negligence, or to any compensation claims due to the loss of life, physical injury or damage to health and the infringement of essential contractual obligations.

Data protection

All personal data entered by the participant on the competition form shall be stored and used solely for the purpose of organizing and staging the competition. If the prize is sent by a third party, the name of this third party shall be stipulated on the participation page. The winners' participation data shall be transmitted to this third party so that the prize can be sent to the winners. The participant shall be entitled to withdraw from the competition at any time. Final provisions

German law shall apply to the competition to the exclusion of the conflict of laws. If individual provisions of the Participation Conditions are or become invalid, the validity of the other provisions shall not be affected. The competition organizer's decision shall be final.
